Hyderabad, July 24 (Namaste Telangana): The State High Court has commented that the situation has arisen where people get scared just hearing the name of Hydra. She expressed her astonishment that key departments like revenue and irrigation have been crippled and eventually even the police are giving petitions to Hydra. She asked how a person can be given such extraordinary powers. In that case, the bench said that it would be enough if the state government repealed all the laws of the government departments, closed down all the government departments and implemented only one law called ‘HYDRA’. Medchal – The hearing continued on Friday in the contempt of court case filed by Santa Sriram Constructions against hydra demolitions in 40 acres of land in Lotkunta village survey number 1, 2 of Malajigiri mandal, Malajigiri district. On this occasion, Justice Jukanti Anilkumar once again opened fire on Hydra.
Even though three contempt petitions were filed simultaneously in the same case and the High Court passed orders one after the other, HYDRA was taken seriously. In the affidavit filed on Friday, it was said that the absence of an apology at least once was shocking. It has been alleged that an unconditional apology in contempt of court cases usually takes place within the judicial process, but Hydra is going above and beyond that. It has been clarified that a comprehensive affidavit should be filed seeking unconditional apology for violating the court orders. He ordered to give a clear assurance that Hydra will not enter the disputed area again. He was ordered to submit full details of the reasons why he had to enter the premises belonging to the petitioner on 18th of this month. They said that they are suspending their orders to take military action only because the Advocate General came and asked for it.
Repeal other laws
During the hearing, the judge raised many questions on the jurisdiction of HYDRA. He commented that he was speechless when he saw the extraordinary powers granted to Hydra. It was objected that the body constituted by a government body was bypassing the statutory powers of all the departments and was doing the trick. According to Sections 6 and 7 of the Revenue Act, the Revenue Department has clear powers to take action against land encroachment. Then he (Hydra Commissioner) denied what he was doing there. ‘Is he a law? Revenue Department, Irrigation Department… Everyone is going to him. Why?’ He asked. In the end, the police also questioned why they resorted to Hydra and who created this situation. Hydrane does everything without working with government laws.. it should be done.. If you think that all the rest are government departments, then it is enough to cancel those laws and make Hydrane a law, he said bitterly. The judge vehemently rejected HYDRA’s contention that defense officials had served them with a petition seeking protection of the land.
How are all the vehicles coming?
The judge ruled out the hydra commissioner’s move to the disputed site on the grounds that an anonymous organization called ‘Save the Rocks’ had filed a petition. ‘Now they will create another letter from another department and go again. Does he go everywhere like this?’ He asked. He denied why he was taking the police and who gave him that authority. They questioned how he was traveling in more than ten vehicles wherever he was going, where were the JCBs and vehicles coming from and what were the facilities given to him according to JV-99. They expressed concern that they are creating fear in people’s minds. There are many other good things Hydra can do, but it is deliberately discriminatory, he said. More than 40 ponds have been captured. But, Hydra doesn’t touch them in the least. We all know the reasons.’
Never seen such an officer
The judge remarked that never in the history of law has an officer been seen with such contempt for court orders. It has been stated that the implementation of the orders issued by the Army on Thursday was stopped because the State Advocate General himself appealed to the court and assured that the orders of the High Court will be implemented without fail. It was clarified that the Commissioner was left out of respect for the AG. No court could entertain the filing of three contempt petitions in respect of the same case. So somebody has to stop it, otherwise it will go too far, he commented. He said that strict measures have to be started somewhere. Ranganath appeared in the court and questioned how to understand if the assurance given by the AG was not valued.
High Court has not heard in the history
The judge reminded that the Hydra Commissioner was not even a party at any stage from the writ petition to the appeal, the civil suit and the first contempt of court case. He said that he suddenly intervened in this matter and violated the orders given by the tribunals, which was never heard in the history of the High Court. During the last two contempt of court cases, the Collector stated that acting contrary to the assurances given by HYDRA that they will surely comply with the court orders is a matter to be taken seriously. Hydra officials are warned to remember that they are not above the law and that they are not out of their reach. He said that the orders of the court should be implemented or else an appeal should be made, this is the law. He said that it should be remembered that the petitioner is not allowed to even touch the place until he files an SLP in the Supreme Court after the order of the court and gets an order.
Do you flout the law?
The judge severely faulted the ‘Standing Council’ for making any gesture while passing the order. Want to record these actions? He asked. Hitavu said that once the matter of ‘standing council’ should be forgotten and this matter should be seen from the people’s point of view. Once those who were sitting on the other side commented that they should stand on this side and see the facts. They asked what you would do if the Hydra officials came to your house tomorrow night and demolished it. Mocking the law, making fun of the law, making fun of the judicial system, committing acts of contempt of the court without deliberately implementing the court’s orders, and making a mockery of the orders of the courts, the judge warned that the hydra actions will not be ignored. At least apologize?
The judge faulted the affidavit submitted on Friday for being poor. It is known that unconditional apology in cases of contempt of court is customary in the legal process and the same procedure should be followed in law. But, even after three contempt of court petitions were filed in the same case, the Hydra Commissioner filed an affidavit stating that he had done no wrong without giving any unconditional apology.
It has been made clear that an affidavit containing unconditional apologies has to be submitted before the next hearing on Monday. The judge expressed surprise that the counter was being filed in such a short period of time and that he was seeking permission to submit an additional counter affidavit in detail. He commented that he does not understand what is meant by ‘detailed additional counter affidavit’ in view of the fact that HYDRA’s actions clearly show contempt of court. However, considering the assurance given by the AG, they said that they are exercising restraint. He said that after examining the points in the affidavit to be filed by Hydra, a decision will be taken on the implementation of military action orders. The next hearing was adjourned to 27th of this month.
Do you think he is a law? Revenue Department, Irrigation Department… Everyone is going to him. Why did the police end up resorting to HYDRA? Who created this situation? If you think that Hydrana will do everything without working with other government departments, why not repeal all other laws and make Hydrana a law? – High Court
Seeing the extraordinary powers granted to Hydra is speechless. An organization created by a government body is bypassing the statutory powers of all departments and is begging. According to Sections 6 and 7 of the Revenue Act, the Revenue Department has clear powers to take action against land encroachment. So what is he (Hydra Commissioner) doing there? – High Court
