Hyderabad, July 23 (Namaste Telangana): The state high court has warned that it will order military action against HYDRA for repeatedly violating court orders. It has stated that the entire army will be deployed if necessary to protect the disputed area in the Army Zone. If anyone comes against their orders, they will ask the army to take them into custody and throw them in the army barracks and produce them in court. It has made it clear that if Hydra is left like this, it will create anarchy in the state and it will not be allowed to happen under any circumstances. The High Court has directed the Registrar General to immediately approach the senior brigadier and ask him to appoint 10 army personnel. It has been made clear that the Army will not be called in as part of the protection of the rule of law as the confidence in the state administration has eroded. She commented that those sitting in the secretariat need to know what is happening in the state. We will instruct the army to detain anyone who violates their orders and enters the land. However, at the last minute, the order was stopped at the request of the Advocate General. The hearing was adjourned to Friday.

Deploy the army

But they expressed deep anger that hydra officials going to that land again would be an insult to the judicial system. ‘Tell him to stay away. Otherwise, we will tell the Union Ministry of Home Affairs and the Ministry of Defense and send the Army into the field,” he said. An IPS officer warned that under no circumstances will this be neglected.

They said that he can stay with the government and cannot go into private property. As the place is in the Army zone, the Registrar General of the High Court was ordered to deploy the Army to protect it and to consult with the Senior Grade Brigadier of the Bison Division. It was stated that 10 Army personnel of Lance Naik rank headed by an officer of the rank of Sub-Lieutenant should be deployed there and asked to give their names on Friday.

If dropped in army barracks..

Justice Anil Kumar reminded us that under any circumstances, Hydra should not go into the disputed land and if necessary, a petition should be filed in the high court. But, instead of doing so, why did they go to that area again? ‘Do you think you are above the law?’ He asked. He commented that we will show something.

It is stated that the army will be instructed to detain anyone who disobeys the court orders and detain them and throw them in the army barracks. They said that their vehicles will also be seized and after that they will be produced before the court. ‘The court does not need to persuade you to implement our judgment. This is a serious insult to the court. Let him also know the power of the judicial system of this country.

Lost faith in the government

Justice Anilkumar said that they know that the Army should not be deployed in the field, but it is not part of the rule of law. “The court is aware that the army should not interfere in such matters. However, due to the lack of trust in the state government machinery, the army has to give orders. A senior IPS officer is not listening to our orders. How can we think that other officials in the state will care?” he asked. He said that even those sitting in the secretariat need to know what is happening in the state.

Anarchy reigns

The bench made serious remarks that if Hydra is left like this, anarchy will reign in the state. She was angry that they were acting as if they liked outside and were coming to the court and answering in the way they liked. It is clear that such anarchy cannot continue in the state. ‘What do you do with real revenue?’ she asked. ‘Do whatever you want. We are ready to face any pressure from the state government. “But we will deploy the army,” the judge clarified.

Breach of undertaking to court

M Harishkumar, advocate for the petitioner, first heard the arguments. It has been mentioned that Hydra Commissioner Ranganath gave an assurance in the High Court on 20th of this month that he will not go to the petitioner’s place again. He said that in violation of the same, Hydra personnel entered the petitioner’s premises on 22nd of this month. Photographic evidence related to this has been submitted to the court. They were handed over to the judge. He said that on 21st of this month, when the petitioner was carrying out renovation work at his place, Hydra officials came with the police and interfered with the work. They said that they are going to file an appeal and have warned them not to undertake any work.

Additional Advocate General Mohammad Imran Khan made arguments on behalf of the government. HYDRA officials claim that they have not gone into the disputed area. Responding to this, the judge said that Hydra vehicles are clearly visible in the photographs submitted by the petitioner. It is stated that the time and date when the photographs were taken are also on them. It was concluded that this would be a direct violation of the court order.

Stay of issuance of orders on petition of AG

At the stage where the court order would be available in the evening, it was temporarily calmed down with the intervention of Advocate General Sudarshan Reddy. He attended the hearing and assured that HYDRA officials will not enter the land belonging to the petitioner. He said that an affidavit will be filed on Friday. Responding to this, the judge stated that the officer will consider it after filing the affidavit. Further hearing was adjourned till Friday. Due to this, the issuing of orders stopped.

Must obey the law

Justice Anil Kumar made it clear that even the government should obey the law. He deplored how the private land can be entered while the division bench judgment is in force. He asked to tell under which law the court orders were passed in the name of protecting the government land. He reminded that neither the government nor the government officials are above the law and it is a constitutional obligation to implement the court orders.

During the last hearing, it was stated that the court had given leeway by assuring that such incidents would not be repeated. On the contrary, the actions of HYDRA were wrongly said to be deliberate interference in the administration of justice. If there are any objections to the court orders, they can legally approach the Supreme Court, but as long as the orders are in force, they must be obeyed, he said.

At this stage, additional AG Khan once again pleaded for one last chance, but the judge rejected it. Orders were dictated to deploy the Army to protect the disputed site. It is suggested that copies of the orders be sent to the Union Home and Defense Ministries, the Bison Department and the State Government.
